SALEM—The Oregon Department of Energy has filed permanent rules for the Business Energy Tax Credit Program effective July 10, 2012. The permanent rules apply to the old BETC program, which has been replaced by the Energy Incentives Program created by the 2011 Legislature.
Permanent rule details include:
- Application for amending existing projects: Prevents applicants from increasing the amount of tax credit earned.
- BETC sunset date: Incorporates simplified HB4079 sunset date provisions.
- New fees: Adds fees for pass-through services, re-inspections and transfers.
Certified BETC project owners must complete the project and submit the final application by November 1, 2012 to receive a tax credit. Project owners, who started construction by April 15, 2011 and submit evidence of construction to ODOE, have until June 30, 2014 to complete the project and submit the final application.
